Miriam Guggenheim assists a broad range of major food and beverage companies in achieving their marketing goals while minimizing regulatory and litigation risks. With a practical approach backed by over twenty years of experience, Ms. Guggenheim guides clients on every legal and regulatory aspect of the development and marketing of food, ranging from the earliest stages of product conceptualization through global marketing strategies. She helps clients determine whether food ingredients are generally recognized as safe (GRAS) and counsels them on compliance with Food Safety Modernization Act (FSMA) requirements for manufacturing and supply chain considerations. She advises on all aspects of food labeling, including the development of well-crafted, substantiated health benefit and other product claims that are relevant to consumers and resistant to regulatory and litigation challenges. Ms. Guggenheim also helps clients successfully navigate potential crises such as recalls, warning letters, difficult facility inspections, and unwanted Congressional or regulatory attention. In addition to her work for individual clients, Ms. Guggenheim serves as outside counsel to a number of key trade associations, helping them accomplish broad industry objectives by engaging with the FDA, FTC, and Congress.
