Mark is an accomplished trial lawyer and health care attorney with extensive experience representing health care professionals and businesses as they navigate the complex and ever-evolving health care landscape, including managing government investigations and enforcement actions.
His practice focuses on governmental and regulatory compliance, with particular emphasis on internal and external health care investigations, False Claims Act matters, white collar criminal defense, and a broad range of health care litigation.
Mark regularly handles Civil Investigative Demands, audits, compliance reviews, subpoenas, and enforcement actions involving HHS-OIG, Medicare and Medicaid programs, the Illinois Department of Public Health, and state Attorneys General. He also has significant expertise in all aspects of the Illinois Health Facilities and Services Review Board (Certificate of Need), having previously served as its General Counsel.
Mark advises clients on strategies to manage and avoid allegations of health care fraud and related criminal conduct, including issues arising under the False Claims Act, the Anti-Kickback Statute, and Medicare and Medicaid regulations. He provides comprehensive counsel and litigation services to physicians, health care facilities, and pharmacies engaged with federal agencies, and is experienced in Medicare and Medicaid reimbursement disputes, False Claims Act/Qui Tam defense, and a variety of health care transactional matters. Additionally, Mark serves as outside General Counsel to the American Association of Nurse Anesthetists.
