As a Partner in the Banking Litigation and Regional Dispute Resolution groups, James has over 20 years’ experience as a commercial litigator with a wide ranging practice but with particular expertise in financial and professional services; he regularly acts for leading banks and finance companies.
He manages commercial and contractual disputes including banking disputes, enforcement of guarantees, restrictive covenants, warranty claims, sale of goods including retention of title issues, factoring and invoice discounting, professional negligence, commercial and corporate fraud particularly following an insolvency event, including misappropriation and concealment of assets and debt recovery. James also deals with issues arising under the Consumer Credit Act, and handles contentious insolvency work.
He takes a commercial approach to his cases, seeking to find the best practical and pragmatic solution for his clients. He is well versed in resolving matters through ADR, particularly mediation and, where necessary, court action.
Recent instructions include acting for a specialist lender in relation to the enforcement of personal guarantees and claims for breach of contract, negligence, breach of duty and deceit against professional advisers following default on two significant loans.
