Practice Areas
Gavin is an established junior who specialises in Chancery proceedings, especially real property (including as regards TOLATA, mortgages, and landlord and tenant), trusts, contentious probate/inheritance disputes, and related matters. Beyond this, he undertakes contract, commercial and tort cases raising various issues. These often include questions which overlap with his core areas of practice, such as regards fiduciary duties and nuisance/negligence in the context of property ownership. He is also instructed in matters concerning professional negligence, including notably allegations against solicitors undertaking real estate and private client work. He has conducted a number of multi-track trials and appeals, whether led or on his own account. He also appears regularly at mediations. Recent reported cases include Fairpark v Heals [2022] 1 WLR 3931 (stays of proceedings for arbitration), Gavriel v Davis [2022] WTLR 943 (remuneration of executors/summary determination of Part 8 claims) and Colbourne v Cooke [2023] WTLR 43 (extension of time for Inheritance Act proceedings). In a further recent High Court action, Cotes v Cotes, the inroads into his client’s inheritance pursuant to the claimant widow’s Inheritance Act claim were limited to 20% capital, as opposed to the 100% claimed.
Career
Graduated with First Class Honours in Law from the University of Nottingham, followed by the Cambridge LLM. Called to the Bar (Gray's Inn), July 2010, with scholarship for the Bar year.
