Practice Areas
Duncan is a specialist family practitioner with particular expertise in family finance cases, including financial remedies on divorce, co-habitant’s property claims (TOLATA) and financial applications relating to children (Schedule 1 claims). He also undertakes child arrangements cases and disputes relating to children.
He is particularly experienced in dealing with complex and high net worth cases involving companies, partnerships, businesses and pensions (particularly those cases where forensic reports are required). Also, cases where there are issues relating to family trusts and where there is an international element.
His expertise in TOLATA cases means that he is particularly suited to representing clients in financial remedy proceedings where there are third party claims or disputes in respect of the beneficial ownership of properties and involving allegations that a party has an interest in property owned by their extended family.
He also has expertise in dealing with cases where there are allegations of material non-disclosure, financial misconduct and s37 applications where assets have been transferred to third parties.
He undertakes the full range of Children Act cases, including undertaking applications for international relocation.
He is experienced in dealing with enforcement proceedings including committals.
Duncan undertakes Private FDR hearings acting as the evaluator.
