Caitlin Forsyth advises hospitals, clinics, and physician practices on a broad range of healthcare regulatory matters, from compliance with Section 1557's nondiscrimination provisions and ADA Title III accessibility standards to emerging issues posed by AI-enabled healthcare tools. Her work spans advising on scopes of practice for licensed and unlicensed personnel, developing plans of correction in response to CMS survey deficiencies, performing price-transparency compliance audits, and evaluating when identified issues trigger reporting and refund obligations under the 60-day rule. She also provides ongoing counsel on licensure, Medicare and Medicaid coverage and billing, and telehealth.
Caitlin also serves as general regulatory counsel for a variety of clinical, molecular, and toxicology laboratories, advising on a broad range of issues under regulatory frameworks such as CLIA, state laboratory licensing requirements, the Stark Law, the Anti-Kickback Statute, the False Claims Act, and their state law counterparts. Her recent work includes drafting and negotiating laboratory services agreements, responding to inquiries and investigative demands from federal and state agencies, and handling medical record audits and overpayment demands from private payers. Caitlin enjoys collaborating with clinical laboratories of all sizes and stages of development.

Laboratory compliance programs
Advising laboratory industry clients on the development and implementation of comprehensive corporate compliance programs and policies, including the preparation and delivery of compliance training. Also providing guidance on navigating internal and external compliance investigations and implementing corrective actions as needed.
Laboratory mergers and acquisitions
Providing counsel on a range of laboratory industry mergers and acquisitions, with individual transactions spanning from a few million to hundreds of millions of dollars. Representing buyers, sellers, investors, and owners, including private equity and venture capital funds. Leveraging DWT's healthcare M&A team's extensive laboratory industry experience to enhance cost-efficiency and ensure the multidisciplinary expertise required to facilitate successful, fast-paced transactions.
ADA DOJ investigation
Represented a hospital in a U.S. Department of Justice investigation regarding compliance with the Americans with Disabilities Act (ADA), addressing policies and practices for providing qualified sign language interpreters to deaf, deaf-blind, and hard-of-hearing patients. Guided the hospital through implementation and ongoing monitoring of a DOJ settlement agreement.
