We are a vital part of all the industries on which Goodwin strategically focuses, providing transactional support and litigation and investigations counselling. Most often, we become involved at the earliest stages of potential transactions, conducting in-depth employment-related diligence, identifying risks within the area of our expertise and reviewing and revising transactional documents, including with respect to representations and warranties and indemnities. We assist with the design of post-deal covenants and, in many instances, assist with implementation. We provide practical advice to employers with respect to all aspects of the employment relationship, ranging from hiring and disciplinary practices, workplace violence, privacy concerns, issues arising under the Family and Medical Leave Act and other leave and paid time off laws, loyalty issues, and protection of employer goodwill and proprietary information via restrictions on post-employment competition. We spearhead internal workplace investigations, including alleged discrimination or harassment, ethics and policy violations and founders’ disputes, and our lawyers have extensive employment litigation experience involving all significant employment law issues.
