Tax: Indirect Tax | UK Bar

London (Bar)

Tax covers a broad range of matters on both the contentious and non-contentious side. Non-contentious matters include M&A transactions and equity raising issues both at home and abroad, as well as tax advisory work on behalf of corporate clients. Financing and investment management are other key non-contentious tax issues. On the contentious side, disputes with HMRC in the form of litigation, appeals and tribunals form the basis of the British legal market for tax issues. Indirect tax matters, including such duties as VAT and stamp duty, are also covered here, and there is a further separate section on private client tax barristers.

Members regularly appear at all levels of the court and tribunal system, and routinely handle cases before the Supreme Court and the ECJ. The set has been instructed in a number of recent notable matters including defending HMRC in what is seen as test-case for the UK landfill sector concerning whether landfill tax was payable on ‘fluff’ layers within landfill sites. Biffa and other landfill site operators claimed that the waste in the so-called 'fluff layer' – present at the top, sides and bottom of all UK landfill cells – was not disposed of as waste but 'used' in the engineering of the cells. The claimed consequence was that landfill tax was not payable on that waste with over £3 billion of tax being at stake. Other cases of note include Kopparberg and Cider of Sweden vs HMRC, a damages action for tens of millions against the UK for a breach of EU law caused by favouring UK producers of wine and cider in excise duties.
