Career

Carol Cai's been mainly engaged in complicated intellectual property litigation, arbitration, and other commercial dispute resolution matters. She has handled a series of complex commercial litigations involving many multinational corporations and large domestic enterprises. Carol mainly focuses on patent litigation, trade secret infringement disputes, unfair competition disputes, product liability and other intellectual property disputes.

Many of these cases involve complex technical fields, including semiconductors, telecommunications, anti-cancer targeted drugs, seed coating agents, automotive active safety systems (electronic control devices and tire pressure warning devices in brake systems such as ABS,ESP,EBD,OBD,etc.), passive safety systems (safety belts and seat belt pre-tensioning devices, energy absorbing devices,etc.), lithium batteries, transformers for substations,etc.

Before joining Saelink Law, Carol worked in a Chambers Band 1 dispute resolution team at Jun He Law Offices and Baker&McKenzie Fen Xun Law Firm.

Carol was admitted to Peking University Law School with the second place in the Shandong College Province Entrance Examination and finished her bachelor's degree in law and a master's degree in intellectual property law in Peking University. Carol was also exchanged to Stanford University School of Law .

infringement, patent invalidation, malicious litigation,non-infringement litigations (involving LED chips)

• Represented Gregory Mountain Products/Samsonite IP Holding S.A.R.L in more than 20 trademark disputes involving oppositions, administrative appeals, and retrials (reversed effective decisions through SPC retrial procedure)

• Represented Alibaba, Taobao and Tmall in series of data infringement, unfair competition and reputation infringement litigations before Beijing IP Court and Beijing Internet Court

• Presented a Chinese leading mobile phone manufacturer in SEP patent license negotiation with implementer (involving telecommunication standard)

• Represented Cree Inc. and Cree Huizhou in a patent infringement litigation (involving LED chips and its manufacture methods)

• Represented a world leading emergency dispatch system provider in a patent ownership dispute (involving emergency dispatch system)

• Represented a Chinese biopharmaceutical company in a series of patent ownership disputes against a former employee and competitor (involving antibody-drug conjugate)

• Represented Zhenai IT Co.,Ltd. in a trademark infringement retrial dispute against Jiangsu satellite TV and Jin Ahuan, concerning the famous TV show “If You Are the One”. (listed as one of Supreme People's Court 10 typical IP cases of the year)

• Represented Gulong Copyright Management Committee in copyright infringement and unfair competition dispute and other trademark administrative procedures

• Represented Byte Dance in a series of litigations concerning privacy and personal data protection, copyright infringement and unfair competition disputes
