Viviane Trojan is an experienced attorney with more than a decade in dedication for patent litigation. She is particularly involved with strategic counseling and litigation representing national and international innovative companies in high level cases. She developed particular expertise in matters relating to life sciences disputes, including biotech, chemistry, and pharmacy. Mrs. Trojan also advises companies on plant varieties issues. She is active in the fields of standard-essential patents in the ICT field. Viviane is one of the coordinators of the Patent Study Committee of the Brazilian Intellectual Property Association (ABPI) and is actively engaged in IP Committees and activities of professional national and international associations, lecturing on patent litigation in several events including professional and academic courses.
She graduated with an LLB from the Federal Fluminense University, is post-graduated in civil procedure from the Pontifical University of Rio de Janeiro and earned an LLM from the University of California, Berkeley, becoming a specialist in Law and Technology.
After a decade at another very prestigious boutique IP firm in Brazil, she joined Kasznar Leonardos in 2021. Viviane is one of the partners overseeing the strategic patent disputes department at Kasznar Leonardos and is based in Sao Paulo.
Her clients include multinational leading-industry companies on the Internet, Communications and Telecommunications field, pharmaceutical companies, global leaders in agribusiness, food and ingredients, business specialized in breeding and licensing fruits.
Work Highlights
Advised a multinational pharmaceutical company for the launch of a breakthrough in Brazil. Viviane and her team developed strategies to guarantee that the competitor’s patent portfolio would not prove troublesome to the launch of the product.
Represented a company which develops Internet of Things (IoT) solutions to secure its patents and reverse a BRPTO’s decision nullifying the patent in a Post-Grant Review (PGR). Viviane and her team successfully attained a preliminary injunction to uphold the patent’s validity throughout the proceedings, and later successfully won the case on the merits, the patent, thus, being fully restored.
Representing a major agribusiness and food company in a lawsuit filed by a competitor seeking to analyze samples of our client’s trade-secret-protected products. An ex parte Court order was granted to seize the samples of the client’s products, but Viviane and her team successfully halted the examination of the samples until a method is established to determine the alleged infringement without disclosing our client’s confidential information. This matter remains ongoing.
Represented the world’s major producers of tires and associated services in an unfair competition case against a competitor. This competitor violated our client’s intellectual property rights, including trademarks, industrial designs, and patents. Over 10,000 infringing goods were seized. The defendant fought for over a year to recover the seized goods. However, their efforts were unsuccessful until a court-appointed expert conducted an on-site technical inspection. This inspection was strategically requested by our team and granted by the judge to preserve the evidence of infringement. The expert’s opinion was favorable to our client, and the case is currently progressing towards a settlement agreement.
