As the Head of the Disputes & Risk team, Advocate McGuffin specialises in contentious funds, trust and cross-border insolvency matters. He has extensive experience in areas such as fraud, constructive trusts and tracing, trustees’ and directors’ duties, financial services regulatory investigations, with most having multi-jurisdictional element. He frequently advises stakeholders and local and foreign insolvency practitioners in corporate distress situations and is regularly instructed by foreign lawyers to provide commercial cross-border advice. He has also provided expert evidence on Guernsey law to the courts in the United States and Australia.
Career
Advocate McGuffin has been at Babbé since 2008 and has practised as a Guernsey Advocate since 2013. He was appointed a Partner in 2016 and Head of the Disputes & Risk team in 2022. Initially qualifying in 2002 whilst at a boutique Sydney firm, later he worked in London at a number of City powerhouses qualifying in England in 2007. He is also qualified in the Republic of Ireland.

He continues to be instructed, via the top private wealth firms in London, to act for trustees, protectors and beneficiaries in high value, high stakes trust disputes. He has significantly grown the firm’s practice in the regulatory and investigations space including acting in a number of leading appellate decisions.
Advocate McGuffin is a preferred choice for complex trial and appellant advocacy especially in the areas of fraud, investment funds, asset recovery and corporate distressed situations. Most recently he has built a market leading practice with respect to advising on the economic sanctions regime, especially the Russia Regulations, being counsel to High Net Worth individuals, financial instructions, trustees, beneficiaries and liquidators in this complex and challenging area of law.
