Dispute Resolution:
Providing forceful and effective advocacy, the team works across the full range of commercial activity, but with a particular focus on finance-related matters. Babbé is widely acknowledged for its depth and expertise in areas including contentious trust litigation, investment fund litigation, commercial fraud, insolvency, and professional indemnity. It has represented clients in the largest and most complex cases to have taken place in Guernsey and has one of the largest dispute resolution teams in the jurisdiction focussed on cross broader international work.

Financial Services Regulation:
In an ever-more regulated world the firm helps clients ensure that they meet their obligations, whether those relate to AML/CFT, international sanctions, data protection, or any other growing areas in which compliance is a factor. Regulation law is often complex and multifaceted and the penalties for non-compliance can be severe. The firm’s experts assist clients to successfully navigate pitfalls and, should they need it, advocates on their behalf to the relevant regulatory authorities.

Insolvency & Restructuring:
The firm’s experienced team is regularly instructed to provide commercial and time-critical advice to directors, shareholders, lenders, investors, private equity sponsors, insurers and insolvency practitioners in a wide range of corporate distress situations. The firm’s expertise covers directors’ and officers’ duties and liabilities to debt and security restructuring, distressed financing, and disposal of assets by insolvent companies. Babbé advised on the first ever Scheme of Arrangement under Guernsey law. The firm’s experience, combined with its top-flight advocacy capability, has resulted in frequent instructions to advise and appear on behalf of various stakeholders in the largest and most complex corporate insolvencies that have come before the court of Guernsey.

Trusts & Pensions:
Babbé advises on the full range of private and commercial trusts, pensions and foundations. Working closely with the corporate team, the firm provides a fully integrated service, meeting the needs of those in the fiduciary sector, whatever the legal issues they face.
