Simon Du is a Partner in the Shanghai office of GEN Law Firm. He focuses on intellectual property disputes and strategic IP protection, with particular strengths in trade secret enforcement (criminal/civil/administrative), patent ownership and infringement disputes (including injunctive relief), unfair competition litigation, and trademark/copyright confirmation and infringement actions.
With more than 14 years of practice, he advises multinational corporations, PRC listed companies and industry-leading enterprises across manufacturing, communications, chemicals/agriculture, FMCG/retail, culture/fashion, automotive & new energy, film/TV/animation, pharmaceuticals & medical devices, and internet/high-tech sectors.
In addition to IP, Simon has extensive experience in corporate anti-fraud and criminal risk compliance, including internal compliance investigations, risk assessments and response to disputes involving embezzlement, commercial bribery (non-state), contract fraud, forgery of company seals, product defects and substandard products.
Trade Secrets & Unfair Competition
Trade Secret Protection: Establishing comprehensive trade secret protection systems and representing clients in criminal, civil, and administrative disputes involving trade secrets.
-Criminal trade secret case (“acquisition-type” infringement): represented the victim throughout criminal investigation and court trial; the matter was selected as a Guangdong provincial typical case and listed among the “Top 10 IP Trial Cases in Guangdong Province” (2020).
-Civil trade secret litigation: secured interim injunctive relief (in-litigation conduct preservation) to protect the right holder.
-Administrative trade secret enforcement: represented a matter selected as a typical case in Shanghai Municipal Market Supervision Bureau’s 2023 “Guardian” special enforcement action against unfair competition.
Patent Ownership and Infringement Disputes
-Pre-suit injunction: obtained a rare pre-suit preliminary injunction in a patent infringement dispute for the right holder.
-Punitive damages: represented a plaintiff in a patent infringement dispute and achieved five-times punitive damages in first instance.
-IP strategy for capital markets: provided IP dispute and strategy support to domestic enterprises during listing/IPO processes.
Trademarks
-Well-known trademark litigation: successfully stopped use of a similar trademark that had been registered for nearly 20 years; obtained multi-million RMB compensation for the client.
-Represented Honeywell in multiple trademark infringement matters, with certain cases recognized by QBPC annual awards (2015/2018/2020).
