Career

Sidhant, Co-Head of the Commercial Litigation Practice at Sim & San, Attorneys-at-Law, brings over 15 years of experience navigating high-stakes disputes with precision and resilience. With an academic foundation that blends a degree of LLB (Hons) and Physics (Honours), he blends analytical thinking with sharp legal strategy, a combination that sets him apart in the courtroom.

His journey began in the chambers of Mr. Gaurav Pachnanda, Senior Advocate, before joining Sim & San in 2012, where he quickly built a reputation for tackling complex commercial and IP disputes. He regularly appears before the Delhi High Court, Supreme Court of India, and international and domestic arbitration tribunals, advocating fearlessly for his clients.

Known for his calm command of contentious matters, he has led multi-million-dollar cases, drawing on his deep understanding of commercial laws and cross-border litigation strategies. His ability to simplify the most intricate disputes into clear, winning arguments makes him an invaluable asset to global businesses facing high-pressure legal battles.

His career is marked by firsts. In September 2023, he and his team led the first-ever live transcription trial in the Delhi High Court, a breakthrough in modernizing India’s courtroom processes. In May 2024, he achieved a landmark US$ 26.1 million damages award for a client in a patent infringement case- a historic victory that reshaped the landscape of IP enforcement in India.

Sidhant also strategized, filed and prosecuted the landmark case of Bhavik Koladiya v. Ashneer Grover in the Delhi High Court. This was the first case in India, for seeking return of Shares of a company under the Sale of Goods Act, 1930. The firm was successful in restraining the Defendant from alienating the Shares which were worth approximately US$ 100 million.

Beyond the courtroom, Sidhant is passionate about advancing legal thought. He co-authored a chapter on damages in intellectual property disputes for Damages, Expert Evidence, and Valuation in Commercial Disputes in India (First Edition), published by Thomson Reuters, Legal in 2024 offering valuable insights into post-trial damages and IP enforcement strategies.

Work Highlights

1. CS(COMM) 977 of 2016 titled Communication Components Antenna Inc. v. Mobi Antenna Technologies Shenzhen Co. and Ors. - This is a historic judgement since for the first time any court in India awarded compensatory damages for lost profits of USD 26.1 million to a patentee.

2. CS(COMM) 443 of 2020 tilted Lifestyle Equities CV and Ors. v. Amazon Technologies Inc. - Delhi High Court awarded damages amounting to USD 38.78 million to the Plaintiff and issued a permanent injunction, restraining Amazon Technologies Inc. (Amazon) from infringing the trademark “Beverly Hills Polo Club” (BHPC). This is the highest award of damages ever given by an Indian court after trial in any IP matter.

3. CS(COMM) 268 of 2022 titled MakeMyTrip (India) Private Limited v. Booking.Com BV and Ors. - The matter is the first matter in India where the Court had restrained Google LLC to offer registered trademark as a keyword to the third parties to trigger sponsored advertisements. Although now the injunction stands vacated and the matter is set to go into trial.

4. 2024:DHC:3393 - Represented Bhavik Koladiya in his dispute with Ashneer Grover before the Delhi High Court. This was the first case in India, for seeking return of Shares of a company under the Sale of Goods Act, 1930. The firm was successful in restraining the Defendant from alienating the Shares which were worth approximately US$ 100 million.

5. Led the settlement and related negotiations on behalf of BharatPe in the disputes with their former founder Ashneer Grover. This was the most high profile dispute in the Indian start up world. This case sets a strong precedent for corporate governance and shareholder conflicts.

6. Established a credible challenge for Dr. Reddy's Laboratories to the Patent over the wonder drug Semaglutide (OZEMPIC) owned by Novo Nordisk.
