Career
Mohit is a Senior Partner and leads the Commercial and IP Litigation Practice at Sim and San. He has had an illustrious career spanning over 18 years. He started his legal career in the chamber of Mr. Amarjit Singh Chandhiok (Senior Advocate and former Additional Solicitor General of India) and later joined Jyoti Sagar Associates, before finally joining Sim and San in 2008.
With an exceptional blend of courtroom tenacity, strategic foresight, and global experience, Mohit stands at the forefront of commercial litigation - redefining legal success for his clients and setting new benchmarks in the field.
Mohit’s litigation portfolio includes securing groundbreaking victories in intellectual property law. Notably, he played a pivotal role and prosecuting in securing one of India’s largest-ever trade mark damages awards of approximately US$ 39 million in a landmark trade mark infringement case, setting a precedent for brand protection and enforcement. He also contributed to a US$ 26 million lost-profits judgment in a patent infringement matter, marking a significant win for patent holders in India’s evolving IP landscape. He has also been actively involved in IP-Tech litigations against Google's Ad Program and is currently prosecuting a Public Interest Litigation on the adverse impact of use of AI on the rights of authors of copyright works.
Mohit has also got substantial experience in resolving Shareholder, Investor-Promoter and Acquisition disputes by way of arbitrations and litigations in Courts. Mohit represented Bhavik Koladiya in his dispute with Ashneer Grover before the Delhi High Court. This was the first case in India, for seeking return of Shares of a company under the Sale of Goods Act, 1930. The firm was successful in restraining the Defendant from alienating the Shares which were worth approximately US$ 100 million.

Work Highlights
1. CS(COMM) 977 of 2016 titled Communication Components Antenna Inc. v. Mobi Antenna Technologies Shenzhen Co. and Ors. - This is a historic judgement since for the first time any court in India awarded compensatory damages for lost profits of USD 26.1 million to a patentee.
2. CS(COMM) 443 of 2020 tilted Lifestyle Equities CV and Ors. v. Amazon Technologies Inc. - Delhi High Court awarded damages amounting to USD 38.78 million to the Plaintiff and issued a permanent injunction, restraining Amazon Technologies Inc. (Amazon) from infringing the trademark “Beverly Hills Polo Club” (BHPC). This is the highest award of damages ever given by an Indian court after trial in any IP matter.
3. CS(COMM) 268 of 2022 titled MakeMyTrip (India) Private Limited v. Booking.Com BV and Ors. - The matter is the first matter in India where the Court had restrained Google LLC to offer registered trademark as a keyword to the third parties to trigger sponsored advertisements. Although now the injunction stands vacated and the matter is set to go into trial.
4. 2024:DHC:3393 - Represented Bhavik Koladiya in his dispute with Ashneer Grover before the Delhi High Court. This was the first case in India, for seeking return of Shares of a company under the Sale of Goods Act, 1930. The firm was successful in restraining the Defendant from alienating the Shares which were worth approximately US$ 100 million.
5. Led the settlement and related negotiations on behalf of BharatPe in the disputes with their former founder Ashneer Grover. This was the most high profile dispute in the Indian start up world. This case sets a strong precedent for corporate governance and shareholder conflicts.
6. Established a credible challenge for Dr. Reddy's Laboratories to the Patent over the wonder drug Semaglutide (OZEMPIC) owned by Novo Nordisk.
