Class Action Litigation & Technology Disputes

Myriah’s practice focuses on high-exposure putative class actions on cutting-edge privacy, cyber and technology issues. She has an extensive track record of obtaining early dismissals and plaintiffs’ voluntary dismissal of claims, defending cases on the merits, defeating class certification, negotiating favorable individual settlements and curtailing the efforts of professional litigants.

Myriah’s experience includes defending clients in complex data breach class actions, privacy torts, and statutory claims including under Daniel’s Law, BIPA, VPPA, and PTFA, as well as online advertising disputes brought under unfair competition and false advertising theories. She has represented hundreds of clients in pixel tracking and wiretap litigation (CIPA/ECPA) brought as individual and mass arbitrations and in state and federal courts throughout the United States.

Recognized as a Law360 Rising Star in Data Privacy and Cybersecurity, Myriah represented the app developer at the center of the Cambridge Analytica litigation in one of the largest consumer privacy MDLs filed to date. She has also been recognized by Legal 500 U.S. for cyber litigation.

Media & First Amendment Litigation

Myriah represents clients in high-stakes defamation, false light, right of publicity, name, image, and likeness (NIL), and intellectual property disputes. She regularly represents publishers, digital platforms, data companies, and businesses facing claims arising from the publication of public records, reporting on matters of public concern, and the aggregation or distribution of publicly available records. Her work frequently involves disputes over the commercial use of identity, including right of publicity and NIL claims challenging the use of personal information in digital media, advertising, analytics products, and online databases.

Myriah’s matters often involve early motion practice addressing threshold issues such as newsworthiness, consent, First Amendment protections and anti-SLAPP, and statutory limitations on publicity claims. She has litigated substantial truth, opinion doctrine, and the fair report privilege and other constitutional defenses.

Myriah also advises clients on litigation risk arising from emerging business models involving identity-based data products, digital archives, and online information services.

Regulatory Investigation

Myriah defends companies in regulatory investigations arising from data incidents and privacy practices, including inquiries by state Attorneys General, the Federal Trade Commission, and the U.S. Department of Health and Human Services – Office for Civil Rights (HHS/OCR). She has also led cross-border regulatory responses involving the United Kingdom’s Information Commissioner’s Office (ICO) and European data protection authorities.

Compliance & Privacy Program Design

Myriah advises clients on enterprise-wide privacy and cybersecurity compliance programs aligned with state privacy laws (CCPA/CPRA, VDCPA), sectoral regimes (HIPAA/GLBA), international laws (GDPR, UKGDPR) and NIST/ISO frameworks. Myriah has experience advising online retailers on algorithmic and personalized pricing strategies and related compliance requirements.

Myriah supports the design and operationalization of data subject request (DSR) programs, conducts privacy and AI impact assessments, and advises on third-party risk and vendor governance. She counsels companies deploying artificial intelligence and automated decision making systems on compliance, auditability, and bias and discrimination risk mitigation.

Myriah has deep experience in the advertising technology ecosystem, including contextual and behavioral advertising, personalized pricing, and digital marketing compliance. She advises clients on marketing claims, subscription and negative option structures, sweepstakes, and promotional programs under state and federal law, including ROSCA and CARL. Her clients include leading e-commerce platforms, global media companies and retail brands, online services and platforms, consumer healthcare organizations, and financial institutions.

Myriah is a Certified Information Privacy Professional, United States (CIPP/US), and Certified Information Privacy Professional, Europe (CIPP/E), as certified by the International Association of Privacy Professionals (IAPP). She began her career in the Honors Program of the U.S. Department of Justice.

She serves as the Member in Charge of the firm’s San Diego office.
