An expert in the Building Safety Act 2022 Kerry cases is currently acting in a number of high value disputes including the highest value RCO case in the Tribunal. Kerry’s construction work is often related to building safety. Kerry’s property work includes options and overage, and development disputes, freehold covenants, restrictive covenants, easements, land registration, commercial and residential landlord and tenant, conveyancing disputes, mortgages, and nuisance. Commercial disputes are at the heart of Kerry’s practice often including those which arise out of development or property transactions but increasingly Kerry acts in commercial litigation.

Kerry Bretherton KC (1992) (silk 2016) specialises in property, property development, building safety and commercial work. Experienced in the Supreme Court and Court of Appeal in many leading property cases she has been described by clients as “ferociously tenacious” and “excellent on her feet”. She is also known for being “fantastic to work with nothing is too much trouble and her response times are amazing”. Her clients include developers, freeholders, leaseholders and central and local government.

Kerry has co-authored a book with David Sawtell on the Building Safety Act due to be published late in 2025 and contributed to “The Building Safety Act” by Dovar and Sawtell due to be published shortly. Kerry is co-author of “The Electronic Communications Code: A Practical Guide” the 2nd edition was published in May 2023 and Kerry was a contributor to “Service Charges and Management 5th Edition”.
