Kathleen’s healthcare litigation practice focuses on defending providers, payors and healthcare-related organizations in matters involving False Claims Act investigations, Stark Law and Anti-Kickback Statute disputes, telehealth accessibility issues, privacy and cybersecurity litigation, professional discipline matters, and government enforcement actions. Clients value her ability to integrate litigation strategy with regulatory and compliance insight, particularly in highly regulated healthcare environments.
In her white-collar and government investigations practice, Kathleen represents companies, owners, officers and professionals in internal investigations and enforcement actions involving allegations of fraud, corruption, export controls, privacy violations, and other misconduct. She is frequently called upon to lead sensitive internal investigations, respond to subpoenas and civil investigative demands, and defend clients before the Department of Justice, SEC and other federal and state agencies.
Kathleen’s leadership perspective is shaped by extensive in-house experience. She previously served as Vice President and Chief Health Compliance Officer at Oracle Corporation, where she led a global compliance organization and advised on healthcare market expansions, mergers and acquisitions integration, and regulatory issues involving medical devices, artificial intelligence and patient safety in the United States and European Union. Prior to Oracle’s acquisition of Cerner Corporation, she served as Cerner’s Vice President and Chief Compliance Officer, overseeing global compliance programs and high-risk litigation and investigations.
Earlier in her career, Kathleen served as an assistant prosecutor, litigating financial crimes, felony drug offenses, and crimes against women and children. She later practiced in private practice handling civil and criminal investigations, defending whistleblower and qui tam actions, and leading complex internal investigations across multiple federal districts. This combination of prosecutorial, defense and in-house experience allows her to anticipate regulatory priorities and develop strategies that mitigate risk while advancing her clients’ interests.
Kathleen is known for her calm, analytical approach and her ability to unravel complicated factual and regulatory issues. She works closely with clients to investigate thoroughly, identify critical evidence, and present the most compelling case possible, whether before regulators, prosecutors, courts, or juries.
Defends healthcare companies in False Claims Act investigations involving alleged kickbacks and reimbursement issues, significantly reducing potential financial exposure.
Led internal investigations and defended healthcare organizations in privacy and cybersecurity matters involving alleged HIPAA violations and putative class actions asserting wiretapping and related claims, including matters seeking seven-figure damages.
Defended domestic and offshore entities, company officers, and investors in an SEC investigation involving alleged fraud by a cryptocurrency services business, including responding to subpoenas, preparing witnesses, and challenging jurisdictional assertions.
Represents companies responding to federal export control investigations, coordinating cooperation with regulators and defending against potential seven-figure penalties and serious criminal exposure.
Defended healthcare organizations in DOJ telehealth accessibility investigation, successfully negotiating resolutions with federal authorities resulting in no civil penalties.
Served as lead counsel to a higher education institution in an investigation involving alleged inappropriate conduct by a faculty member, successfully defending against most claims dismissed by the court and resolving the matter through a nominal settlement following investigative findings.
