John S. LeRoy is a Shareholder in Brooks Kushman’s Litigation practice and serves on the firm’s Executive Committee. His career has centered on leading complex intellectual property disputes, including patent, trade secret, and copyright litigation involving sophisticated technologies. He has played a key role in shaping the firm’s litigation capabilities, particularly in high-stakes matters involving automotive, software, and telecommunications technologies.

John is recognized for his leadership in standard-essential patent (SEP) litigation, where he regularly serves as first-chair counsel in high-value infringement cases. His work includes defending large-scale claims involving cellular and wireless technologies, often involving significant damages exposure. He leads both liability and damages strategy, as well as parallel post-grant proceedings, providing clients with an integrated and business-focused litigation approach.

Experience

John has extensive experience representing clients in complex intellectual property litigation, with a particular focus on patent disputes involving software and electronic technologies. He has successfully tried patent cases in federal courts and has handled appeals at the Federal Circuit.

His practice includes substantial work in post-grant proceedings, including inter partes review, often in parallel with district court litigation. He has handled numerous IPR proceedings and integrates them into broader litigation strategy to challenge or defend patent validity.

In addition to his litigation work, John advises clients on open source software issues and leads the firm’s open source software practice. This includes counseling on compliance, enforcement risks, and strategic considerations tied to software licensing and intellectual property protection.
