Practice Areas

Centering his practice on issues related to major U.S. environmental programs, Eric Boyd advises clients on litigation, transactions, and regulatory compliance matters. He advocates for clients nationally, with a focus on organizations in Chicago, Illinois, and the Midwest.

As new technologies and environmental issues emerge, he advises clients on issues that involve renewable energy, greenhouse gas emissions, green marketing, and carbon sequestration. Eric obtains variances and site-specific relief for his clients and permits under air, water, wetland, solid and hazardous waste, hazardous materials, and underground injection control programs. When clients’ projects involve federal funding, Eric advises them on compliance with rules for special environmental reviews under the National Environmental Policy Act (NEPA).

Eric proactively counsels organizations on avoiding litigation by staying compliant with all relevant rules, but he also represents clients in a wide spectrum of litigation. With particular experience in and knowledge of the legal implications of the Clean Air Act (CAA), he handles highly complex air permitting and air enforcement matters and advises on issues relating to start-up and shut-down malfunctions, indoor air quality, new source review, new source performance standards, national emissions standards for hazardous air pollutants, odor and dust nuisance, off-site releases, environmental justice initiatives, and other matters.

Clients frequently rely on Eric to help them navigate significant Clean Water Act (CWA) issues. He represents them in cases and appeals involving water quality standards, water treatment permits, effluent limits, and challenges to real estate and highway projects. In addition to providing counsel in litigation pertaining to contaminated sites and alleged violations of Department of Transportation (DOT) hazardous material transport requirements, he guides clients in real estate and corporate deals in which environmental compliance and contamination issues play a role.
