A founding member of Erise, Eric is a patent litigator with a track record of success in venues across the country.
What sets Eric apart from other patent litigators is his unconventional approach to case strategy: He likes to say the best way to win a patent trial is to not try it like a patent case. Eric is a storyteller at heart, and he brings that style to each of his matters, seeking universal themes and narratives that will resonate with judges and jurors.
A mechanical engineer by training, Eric currently represents clients in multiple fields, among them video game technology; networking equipment and network security; deep packet inspection technology; digital rights management; GPS systems; e-commerce; and multiple other types of consumer electronics.
Outside of the firm, Eric dedicates time to serve as a board member for several not-for-profit organizations.
• Eric has litigated more than 200 patent infringement matters in district courts across the nation; most notably, he secured four consecutive defense verdicts in the U.S. District Court for the Eastern District of Texas.
• He has been lead counsel in more than 30 appeals at the U.S. Court of Appeals for the Federal Circuit.
• He has filed more than 115 inter partes review proceedings at the Patent Trial and Appeal Board, with a high rate of success that contributes to the firm’s overall ranking in the top 20 “go-to” firms for IPRs nationwide.
• He secured a complete defense verdict of noninfringement for Sony, which was accused by video game developers of infringing patents related to video games and consoles. The Eastern District of Texas verdict was subsequently upheld by the Federal Circuit.
• He successfully pursued IPR proceedings to invalidate the patents at issue in a second allegation of video game patent infringement. The PTAB invalidated three patents and 21 total claims, ending the underlying litigation.
• He obtained a full defense verdict in the Eastern District of Texas for NetScout Systems, which had been accused of patent infringement by a patent holding company. The jury deliberated for less than one hour.
