Emily Kimball

Emily Kimball counsels and advocates for clients in the transportation industry and has a focus on environmental matters. Emily advises rail industry clients on matters related to regulatory compliance and enforcement, transactional diligence, and advocacy before federal agencies. Emily represents corporations and trade associations in the rail sector on various regulatory matters before administrative agencies and quasi-regulatory bodies, including the U.S. Department of Transportation and its agencies, the Federal Railroad Administration and the Pipeline and the Hazardous Materials Safety Administration; the Surface Transportation Board (STB); and the Association of American Railroads. Emily counsels clients on matters related to the transportation of crude oil and other hazardous materials by rail and has worked extensively with tank car manufacturers, tank car lessors, and other members of the railway supply industry. She has filed numerous comments to agency proposed rulemakings, including PHMSA's enhanced tank car standards for high-hazard flammable trains. Emily also represents shippers and private car owners and lessors in challenges before the STB regarding the legality of railroad practices. Emily’s environmental experience includes helping clients comply with the Clean Air Act and respond to U.S. Environmental Protection Agency (EPA) information requests and enforcement actions, for both mobile and stationary sources.
