Career
David is a major figure on the commercial litigation and arbitration scene, both onshore and internationally and appears in both the Commercial Court and the Chancery Division of the High Court, as well as the Appellate Courts including the Privy Council. The cases that David acts on tend to be extremely large and complex, invariably with a multi-jurisdictional element. Internationally he appears regularly in different Caribbean jurisdictions and recently before the Supreme Court of Seychelles as well as acting in the BVI, Caymen Islands, Europe and Far-East.
He has been involved in a number of cross-border insolvency proceedings and has been heavily involved in Madoff related litigation in the BVI, Court of Appeal of the Eastern Caribbean and Privy Council acting on behalf of Swiss Banks, and in proceedings brought in the Cayman Islands by the liquidator of a Cayman Fund against the directors of the Fund to re-claim redemption payments from investors made before the liquidation.
Recently he has been involved in cases concerning secret and half-secret commissions. He appeared before the Court of Appeal in Business Mortgage Finance v Wood and Pengelly and in Expert Tooling v Engie.
