Daniel N. Gonzalez concentrates his practice on complex litigation, insolvency matters, financial restructuring and reorganization, creditors’ rights, bankruptcy related litigation, bankruptcy trustee/fiduciary representation, and asset transactions in liquidation proceedings (representing both purchasers and sellers). Work Highlights

Bankruptcy Restructuring:

• Represents private lender Fuse Funding, LLC in the Chapter 11 bankruptcy case of Metronomic Holdings, LLC. The loan was secured by mortgages on numerous commercial properties in prime residential areas in Miami. With the Firm’s guidance, Fuse entered into a bankruptcy court approved agreement with Metronomic in which numerous debtor and non-debtor affiliated entities were substantively consolidated and provided for the sale of the 19 parcels.

• Represented James S. Howard, as the assignee for the benefit of creditors. Prior to entering into an assignment for the benefit of creditors, Bonamar was the largest fin crab (i.e. blue crab) distributor in the United States, with secured debt of over $22M. Meland Budwick also advised on all legal matters related to the assignment proceeding, including the selling of assets and the bringing of causes of action. Ultimately, Mr. Howard collected over $18,000,000 recovered either through asset sales or litigation and the court approved the closure of the case and an approximate 10% distribution to creditors.

• Currently representing an assignee in the assignment for the benefit of creditors in the related cases of In re Farartis, LLC and Panamerican Food, LLC. To date, the Assignee, with counsel from the Firm, has sold over $1.3M of equipment owned by Farartis and collected over $900,000 in receivables on behalf of Panamerican.

• Represented Dimension Capital Management in the Chapter 11 case of FF Funds, LLC (“FF Fund”), in which case DCM is the largest general unsecured creditor. The Firm counseled DCM through the FF Fund’s Chapter 11 plan confirmation process.

Bankruptcy Litigation:

• Represents group of six related defendants in a fraudulent transfer action seeking the avoidance and recovery of $6,000,000 in transfers.

• Serves as special litigation counsel for the bankruptcy trustee of MJD Legacy Investment Corporation, an entity that engaged in an alleged fraudulent investment scheme with losses in excess of $8 million. Meland Budwick is responsible for investigating and bringing all clawback and avoidance claims against MJD’s insiders and third-parties.

• Retained as special litigation counsel as Chapter 7 trustee of EFO Holdings, L.P., to investigate and then pursue a nine figure professional negligence claim against an Amlaw 50 law firm.

• Serves as special litigation counsel for the bankruptcy trustee of G&C Investment Corporation, an entity that engaged in a fraudulent investment scheme - with losses in excess of $10 million. Jorge Garrido, the owner of G&C Investments, pled guilty to perpetrating a multi-million dollar investment fraud scheme. Meland Budwick is responsible for investigating and bringing all clawback claims.

Commercial Litigation:

• Represented individual in Miami-Dade County state court seeking the enforcement of a $1,000,000 settlement reached between the individual and the opposing party. After a two-day evidentiary hearing, the court ruled in favor of our client and entered a judgment in excess of $1,000,000 against the opposing party.

• Represented Kavlar Gardens, LLC, the owner of a valuable large tract of developable vacant land in Homestead, Florida, in a specific performance suit filed against it by a proposed purchaser of the property. The court granted summary judgment in favor of Kavlar and against the proposed purchaser.

• Serves as outside litigation counsel to a Mexican food restaurant chain, handling or advising on all its litigation matters.
