Work Highlights
Bankruptcy Restructuring:
-Represented first position secured creditor Cirrus Real Estate Funding, LLC, in the Chapter 11 bankruptcy case of BH Downtown Miami, LLC, pending in Miami. Advised Cirrus on all Chapter 11 matters in this case, including defending Cirrus in a heavily contested adversary proceeding brought against it by BH Downtown, as well as BH Downtown Miami’s sale efforts and representing Cirrus in its credit bidding acquisition (sale closed in Q1 2026). The land owned by BH Downtown Miami is one of the few last developable parcels of waterfront property in downtown Miami (the land is valued at over $100m).
-Represented $11m plus secured judgment creditor in the Chapter 11 jointly administered bankruptcy cases of Tzadik Properties. Successfully defended against the debtors’ threats of potential avoidance actions, and ultimately obtained very favorable plan treatment for the client which will result in full payment of the client’s claim.
-Represented Integra Realty, LLC, as the $20.5m stalking horse bidder in the Heron Pond Condominium Association receivership case. In this role, Dan and the firm advised Integra in all aspects of the transaction, including negotiating the stalking horse agreement, representing Integra in a contested sale hearing (Integra prevailed), and closing on the transaction.
- Represented the Official Committee of Unsecured Creditors in the Chapter 11 mega case of In re Eiger Biopharmaceuticals filed in Dallas bankruptcy court and secured a 100% distribution to the unsecured creditor class.
- Represents the majority equity owner in the Chapter 11 case of In re Leisure Investments (Dolphin World), which case is pending in the Bankruptcy Court for the District of Delaware.
- Represented nine affiliated Florida dental practices in their assignment for the benefit of creditors proceedings.
- Represented the largest unsecured creditor ($40M) in the Chapter 11 bankruptcy case of a Florida law firm.
- Represented group of 22 medical malpractice claimants in the jointly administered Chapter 11 bankruptcy cases of Envision Healthcare Corporation, pending in the Southern District of Texas Bankruptcy Court – Houston Division.
- Successfully represented secured creditor in a Chapter 11 case involving two private jet aircraft.
Bankruptcy Litigation:
- Represents a $10.6mm judgment holder in the jointly administered Chapter 11 bankruptcy cases of In re Tzadik South Falls Portfolio I, pending in the Bankruptcy Court for the Southern District of Florida.
- Represented group of six related defendants in a fraudulent transfer action seeking the avoidance and recovery of $6,000,000 in transfers (case was resolved favorably for the clients).
- Serves as special litigation counsel for the bankruptcy trustee of MJD Legacy Investment Corporation, an entity that engaged in an alleged fraudulent investment scheme with losses in excess of $8 million. Meland Budwick is responsible for investigating and bringing all clawback and avoidance claims against MJD’s insiders and third-parties.
Commercial Litigation:
-Represented individual in Miami-Dade County state court seeking the enforcement of a $1,000,000 settlement reached between the individual and the opposing party. After a two-day evidentiary hearing, the court ruled in favor of our client and entered a judgment in excess of $1,000,000 against the opposing party.
-Represented Kavlar Gardens, LLC, the owner of a valuable large tract of developable vacant land in Homestead, Florida, in a specific performance suit filed against it by a proposed purchaser of the property. The court granted summary judgment in favor of Kavlar and against the proposed purchaser.
- Represented minority shareholder in a shareholder dispute involving allegations of breach of fiduciary duty, fraud, and self-dealing. Case was recently resolved in favor of client with a seven-figure settlement payment.
