PSV 1982 Limited v Langdon [2022] EWCA Civ 1319, [2022] Bus. L.R. 1244 – acted for successful respondent - authority on whether judgment against company establishes debt against director and time at which the liability is incurred for the purposes of S 217 Insolvency Act 1986.
Mint Bridging v Earthrise Developments [2021] EWHC 3800 (Comm) – acted for successful claimant - authority on anti-set off clause; the effect of entry into a re-mortgage on the entitlement of the borrowers to rely upon an alleged breach of the original mortgage with the same lender in response to a claim for enforcement of the re-mortgage and the entitlement of a lender to rely on a conclusive evidence clause.
Perry v Neupert [2019] EWHC 2275 (Ch) – acted as junior counsel for successful applicant - authority on the incidence of costs in proceedings in which the beneficiaries under a will had sought the removal of the named executor in circumstances in which the executor originally opposed his removal before agreeing to be removed in favour of an independent person.
Halsall v Champion Consulting Ltd [2017] EWHC 1079 (QB), [2017] PNLR 32 – authority arising out of claim against accountants for negligent advice concerning tax avoidance schemes. Case dealt with numerous issues including scope of duty, breach, exclusion of liability and S14A Limitation Act 1980.
Bhullar v Bhullar [2015] EWHC 1943 (Ch, [2016] 1 BCLC – authority on test for permission to continue derivative action and availability of indemnity out of company assets for the claimant.
Dutton v Minards [2015] EWCA Civ 984, [2015] 6 Costs LR 1047 – acted for successful respondent as sole counsel - authority on exercise of discretion as to costs following late acceptance of Part 36 offer.
Webster v Liddington [2014] EWCA Civ 560, [2015] 1 All E.R. (Comm) 427– acted as junior counsel for successful respondent - authority on responsibility of medic for representations contained within manufacturer’s literature provided to patients to encourage them to undergo treatment
Parking Eye v Somerfield Stores [2012] EWCA Civ 1338, [2013] QB 840 –acted as junior counsel for successful respondent - authority on effect of illegality on contracts, which introduced the notion of proportionality in determining the effect of illegality and was referred to by the subsequent Supreme Court authority of Patel v Mirza.
