Renowned as an entertainment industry leader by Chambers USA, Billboard, and The Hollywood Reporter, Andy Bart serves as co-chair of the firm’s nationally recognized Content, Media, and Entertainment group. For more than four decades, he has focused on litigation in the entertainment industry, with an emphasis on intellectual property issues and contractual disputes. For the past 25 years, he has focused on issues involving the intersection of content and technology which has helped to define the parameters of the Digital Millennium Copyright Act (DMCA). Andy’s cases have resulted in precedent-setting decisions in copyright law, trademark law, the law of privacy and publicity, and artist-label relations.
Clients seek Andy’s counsel on their matters of consequence. In the entertainment industry, record labels, motion picture studios, music publishers, streaming services, trade organizations, and artists, rely on his sound counsel on intellectual property issues and contractual disputes. Andy represents plaintiffs and defendants in music copyright claims, defends studios and advertising agencies against copyright infringement claims, and addresses issues of copyright termination and joint authorship. He also handles contract and accounting claims relating to sound recordings and musical compositions and has significant experience and a record of winning industry-leading cases involving claims arising under trademark and Lanham Act, as well as claims under state doctrines of unfair competition and right of publicity.
Andy has handled literally hundreds of cases in the music and film industries. He has tried or arbitrated dozens of matters, mediated many more, and settled even more. He operates at the intersection of content and technology and deeply understands the importance of applying a measured sense of cost/benefit analysis to litigation, and of proactively setting litigation goals.
