Firm Overview:
Vestius Advocaten is a specialist law firm with its office in Amsterdam. Vestius Advocaten focuses entirely on employment law and corporate law. The lawyers view cases not only from a purely legal point of view. The key features of Vestius Advocaten are a pragmatic approach and an alertness to the clients’ needs.

Main Areas of Practice:

3 partners; 3 associates; 1 of counsel
Sandtrade/Sandvik group
Santrade Schiedam is one of the main distribution centres of the Sandvik group and the largest distribution centre in Europe. Santrade distributes special metal and carbide tools. Vestius litigated on behalf of Santrade the unilateral termination of the employment agreement of an employee that worked for the company for almost 20 years, based on a disturbed relationship. The employee claimed that the company acted seriously culpable towards the employee and therefore the dismissal request should be denied or a ‘fair compensation’ of almost EUR 250,000 should be rewarded. The Rotterdam Court terminated the employment agreement at the request of Santrade, denying the claims submitted by the employee
Sandvik Mining and Construction/Sandvik Benelux
Sandvik Mining and Construction B.V. is the Dutch entity of the Swedish publicly listed company of Sandvik Group, a global engineering Group with more than 47,000 employees, providing services for tooling systems for the mining and construction industries. Sandvik is based in all 5 continents and most of the European countries. A substantial part of the local business in the Amsterdam Headquarters, has been relocated to the respective Sandvik home countries in Sweden and / or Finland. Vestius executed and supervised this relocation and the related reorganisation.
Urban Outfitters
URBN is a portfolio of global consumer brands comprised of amongst others Urban Outfitters, Anthropologie and Free People. While the company in the Netherlands is managed from the UK, there are also several English nationals who work for the company in the Netherlands. Vestius has advised URBN on the consequences of the Brexit for employees in the Netherlands in terms of employment law
Check in Cleaning
Check in Cleaning is a cleaning company with more than 200 employees, mainly providing cleaning services for hotels in Amsterdam. After terminating the cleaning contract with one of the hotels, the successor (one of the largest cleaning companies in the Netherlands) stated that Check in Cleaning incorrectly claimed that taking over the cleaning assignment qualified as ‘transfer of undertaking’. The matter was brought before the Amsterdam Court in summary proceedings. The preliminary assessment of the court is that Check in Cleaning’s claim was correct; thus, overruling the provisions of the applicable collective labor agreement in the cleaning sector. Vestius advised and litigated the summary proceedings on behalf of Check in Cleaning
Celigo, Inc.
Vestius has been involved in setting up the Dutch entity of Celigo, Inc., a Silicon Valley IPaas software company. It was a greenfield operation in which the company was set up from scratch, together with Dutch civil notaries. Advice was given on employment contracts, remuneration packages, personnel handbook and everything related to this
Vestius has represented AFS in litigation against a competitor for unfair competition. The competing organisation took over employees while it knew about the existence of the non-competition clauses. After initiating court proceedings, the case was settled
