QA Legal was founded in 2018 by María Teresa Quiñones, who is recognized in the Peruvian legal market as a leading expert in the fields of energy, infrastructure, public law and telecommunications, with more than 25 years of legal experience and who is a frequent legal expert in Administrative Law in ICSID arbitrations. QA Legal is a legal boutique that has positioned itself as one of the go to firms in these practice areas.

Partner Lucía Olavarría joined the firm in 2020, after more than 10 years as a senior associate in the arbitration practices of two top-tier local law firms. She also was Foreign Attorney in the international arbitration practice of a Washington DC firm, advisor to the Vice-president of Countries of IDB and advisor to the Ministry of Energy and Mines of Peru. She leads the firm´s arbitration practice and is also recognized for her expertise in telecommunications and energy.

In 2021, the firm took a step further, adding Jessica Cubas as a third partner. Jessica, a construction and legal innovation expert, expands QA LEGAL’s services to counsel in construction contracts and claim management; also reinforcing its construction dispute prevention and arbitration expertise.

At the associate level, the team is formed by highly specialized young lawyers, who are also involved in academics and research. Many of the associates at QA LEGAL have worked at the Peruvian electrical grid operator, as well as in other leading public entities.

The firm has a genuine commitment to diversity which is reflected in having three female partners and in its participation in important initiatives such as Women In the Profession (WIP Perú) and the Equal Representation in Arbitration Pledge (ERA Pledge). María Teresa Quiñones has also participated as a mentor in Women In Energy (WIN-Peru).

Main Areas of Practice: 

Energy: 

Design and implementation of power generation and electric transmission projects, including renewable energy projects. Legal advice on gas transport and distribution contracts, controversies and regulatory matters. Negotiation, drafting and performance of power purchase and interconnection agreements. Expert opinions in domestic and international controversies. Advice regarding regulations applicable to the electricity market and natural gas supply chain.

Arbitration: 

Highly specialised advice in complex domestic, international, and investment arbitration proceedings. Participation as party representatives, arbitrators and legal experts in both international and domestic arbitrations. The team is well-trained on the application of the arbitration rules of ICC, UNCITRAL, and the most representative arbitration centres in the country.

Projects and Infrastructure: 

Development and operation of infrastructure projects (ports, airports, toll roads, railways, transmission lines and sanitation).

Public-Private Partnerships (PPP) in infrastructure, transport, sanitation, energy and telecommunications projects. Concessions, authorisations, permitting, tariffs, open-access and interconnection.

Design and implementation of private bids for infrastructure and construction projects. Drafting, negotiation and performance of BOOT Contracts, EPC Contracts and Design and Engineering Contracts.

Expert opinions in national and international arbitrations (ICSID) regarding Public Law, Infrastructure Law and Public-Private Partnerships.

Domestic and international arbitrations regarding concession and investment contracts.

Public Law: 

Rendering of legal opinions on public and administrative law and regulatory matters. Advice in connection to concessions, authorisations, permits, tariffs, sanction proceedings, contentious administrative litigation.

TMT: 

Advice to incumbents and new entrants on telecom regulations, licensing, and permits. Represent clients before the telecom authority in tariff setting and other regulatory proceedings. Advice on draft legislation. Obtaining concessions, authorisations, and licenses for telecommunications services. Transfers of concessions and spectrum rights assignments.

Construction: 

Drafting and negotiation of Design, EPC and BOOT contracts and other construction-related agreements. Advice in procurement, risk and claim management. Design of strategies for managing and settling claims for additional costs and extension of time. Representing clients in construction contract arbitrations.

Memberships: 

María Teresa Quiñones is a member of the International Arbitration Court of Amcham Perú. She is also a member of the board of the Peruvian Society of Construction Law and a member of WIP-Peru Advising Committee.

Lucía Olavarría was ICC YAF representative for Latin America in the period 2019-2021 and a member of the Steering Committee of the ERA Pledge.

Jessica Cubas was a member of the board of the Peruvian Construction Law Society (2019-2021) and is a member of WIP-Peru Leadership Committee.
