Profile

Provided by Fleet Hamburg

Fleet Hamburg is a partnership of lawyers admitted in England and Germany. Our relationship with our clients is also a partnership – we approach each set of instructions as your partner, ready to fully commit ourselves to your interests. Excellent legal know-how is the basis of our service; add to that our knowledge of the industry and markets, and we help you overcome everyday as well as extraordinary challenges, and identify not only risks but also opportunities, so that you can successfully exploit your economic potential.

Our clients operate nationally and internationally – in trade, shipping, logistics, engineering, aviation and the energy and offshore sectors. We serve trading houses, logistics service providers, manufacturers, suppliers, shipowners, charterers, ship operators, P&I Clubs and insurers. They all profit from our in-depth knowledge of the industry and our commitment.

Labour Law

We advise individual entrepreneurs as well as global players on the many facets of individual and collective employment law. For historical reasons, we also focus on the maritime sector. We advise on national and international maritime employment law issues (such as SeeArbG and MLC) and have many years of experience in negotiating collective bargaining agreements for the cruise industry.

English Law

Our team of barristers and solicitors will answer all your questions and assist you in drafting and negotiating contracts. We are experienced litigators before the English High Court as well as before all English and international arbitration tribunals (LCIA, LMAA, GAFTA, FOSFA and ICC proceedings).

Corporate and Insolvency Law

We assist you in the formation and registration of partnerships and corporations in Germany as well as so-called special purpose vehicles (SPV = Single Purpose Vehicles) in common offshore jurisdictions such as Liberia, Marshall Islands, Malta, Gibraltar etc.

Our expertise is in assisting you with questions of management competence or shareholder disputes; and in relation to join venture projects, we think through the possible contingencies in advance, and prepare the negotiations in such a way that nothing stands in the way of the successful implementation of your projects.

Insolvencies are always sensitive and complex proceedings. We advise you comprehensively with regard to the obligation to file for insolvency, the filing of claims in insolvency proceedings as well as in negotiations with insolvency administrators.

Commercial Law

We draft your standard terms and conditions as well as negotiate and finalise individual contracts with your trading and distribution partners.

In the event of disputes with your customers or partners, we are at your side to help find a resolution of the dispute keeping the valued commercial relationship intact. When arbitration or litigation cannot be avoided, our team of first class litigators will represent your interests in arbitration or court proceedings under English and German law.

Maritime and Transport Law

Our legal expertise covers the entire life cycle of a ship. We advise and represent you from the acquisition, commercial operation and maintenance to emergency response. We are also involved in issues of national and international maritime labour law (such as SeeArbG and MLC) and public maritime law such as maritime traffic law, regulatory requirements and orders, and maritime accident investigation proceedings.

Due to the multimodality of today's transport chains, the scope of our services goes beyond pure maritime law and, in addition to pre- and on-carriage, we also advise on unimodal and multimodal transport. Our core expertise therefore extends to generaltransport law and covers, in addition to transport by sea, transport by land (road and rail), air, and inland waterways.

Insurance Law

We are familiar with both national and international regulations and can assist you with all legal issues in the areas of marine insurance, transport insurance, industrial insurance and reinsurance. The focus is primarily on coverage and premium disputes as well as recourse proceedings for insurers. In addition, we advise policyholders, brokers and insurers on the drafting of tailored insurance terms and conditions to cover special risks as well as on the handling of major claims.
