Tomás is a partner in A/C/R’s Dispute Resolution and Antitrust practices. His practice focuses on controversies where law, regulation, and economic analysis converge, with a special emphasis on highly complex strategic, institutional, and reputational matters. He has led the defense of national and foreign companies in the most significant antitrust cases of the last decade -including collusion, abuse of dominance, and gun-jumping- as well as in securities market controversies and consumer class actions. In the commercial arena, his practice focuses on arbitrations regarding corporate matters, disputes within the framework of corporate transactions, and contract disputes across various industries, such as mining, retail, construction, and energy. He complements his llitigation practice with preventive antitrust counseling -including merger control, interlocking, and regulatory compliance- as well as strategic advice to companies across various industries regarding high-stakes decision-making and crisis management.
Tomás is a partner in A/C/R’s Dispute Resolution and Antitrust practices. He holds an LL.M. from Columbia University (2016, Harlan Fiske Stone Scholar, Becas Chile) and a law degree with highest distinction from Pontificia Universidad Católica de Chile (2009). He began his career as an associate at Carey and served in the Litigation Division of Chile's National Economic Prosecutor's Office, the national competition authority, before moving to the defence side as a partner at FerradaNehme and subsequently at Bofill Mir.
Relevant Experience:
· Representation of the leading Chinese company in the lithium industry in a dispute with the Financial Market Commission (CMF), linked to an agreement between the State of Chile and the country's largest lithium marketer.
· Defense of a Spanish conglomerate in the forest firefighting market across three collusion proceedings litigated between 2017 and 2025.
· Representation of a cable operator in an abuse of dominance proceeding against the holder of the broadcasting rights for the national soccer championship, resulting in the latter being ordered to pay approximately USD 28 million.
· Defense of one of the world's most prominent multinational retailers in a multi-million dollar civil dispute with a supplier, as well as in high-impact reputational class actions.
· Representation of foreign power generation companies in international arbitrations regarding breaches of construction contracts.
· Representation of a banking entity in a commercial arbitration concerning forward contracts.
· Defense of a multinational mining company in an environmental damage lawsuit stemming from the sinkhole generated in Tierra Amarilla.
· Defense of a retailer from Valdivia in an unfair competition dispute involving the abuse of legal actions, against the other shopping center operator in the same city.
· Handling of a series of leniency proceedings before the National Economic Prosecutor's Office (FNE).
