We provided legal advice to TELEFÓNICA SEGUROS in connection with the launch and distribution in Spain of insurance products covering cybernetic risks. The main legal challenge concerned the proposed distribution of these products through Movistar retail stores, where the shop assistants involved in the sales process are not qualified insurance agents.

TELEFÓNICA SEGUROS is starting to distribute in Spain insurance products which cover cybernetic risks. We are providing legal assessment about these new products. The most challenging issues were in relation to how distribute these products through their phone stores (Movistar), considering that their shop assistants are not qualified insurance agents. In this case, are they legally allowed to sell insurance products? The legal grounds for this was that the cybernetic insurance would only be a complementary service of the general cybernetic protection product: article 130.2 of the Royal Decree-Law 3/2020 of 4 February on urgent measures transposing into Spanish law various European Union directives relating to public procurement in certain sectors; private insurance; pension schemes and funds; taxation; and tax litigation: Title I shall not apply to supplementary insurance intermediaries carrying out insurance distribution activities where all of the following conditions are met: (a) The insurance is supplementary to the goods or services supplied by a provider […]
