Career

A veteran trial lawyer and former Assistant Federal Public Defender, Samuel Randall has tried more than 20 cases to verdict. Repeatedly recognized for his exceptional accomplishments in the field of antitrust, Sam has been ranked by Chambers USA as a leader in his field since 2021.

Primarily focused on prosecuting claims for companies victimized by domestic and international price-fixing conspiracies, Sam has helped clients obtain substantial recoveries from cartels in industries as diverse as polyurethane foam, eggs, cathode ray tubes, packaged seafood, lithium-ion batteries, and broiler chickens.

Sam’s ability to marshal vast amounts of information and data, problem-solve, and present concise and persuasive arguments in court prove invaluable to clients and their cases. He identifies and develops legal theories and then devises a case strategy to maximize his clients’ recoveries while minimizing the burden of the litigation on their businesses.

Earlier in his career, Sam was a law clerk for the Honorable Adalberto Jordan, District Court Judge for the Southern District of Florida. Sam also taught evidence as an adjunct professor at the University of Miami.

Representative Cases:

After the court ruled adversely to the class on an issue that truncated damages to a four-year period, reviewed the record, drafted a complaint, briefed and argued the motion to dismiss, persuading the court to double the damages period, which more than doubled the period during which the clients could seek damages. In re Pork Antitrust Litigation, No. 18-cv-1776, 2023 WL 6279354 (D. Minn. Sept. 26,2023).

Represented retail pharmacies as plaintiffs in prosecuting the largest cartel case in U.S. history; drafted the first overarching conspiracy complaint alleging price fixing regarding hundreds of different generic drugs as elements of one conspiracy, which enabled the clients to include all claims in one complaint, which made the case triable as a single action and expedited recovery. In re Generic Drug Pricing Litigation, MDL 2724.

Represented Sears & Kmart, as plaintiffs, on price-fixing claims against Korean and Japanese electronics manufacturers; maximizing the companies’ recovery despite the substantial financial hurdles the companies faced. The recovery enabled the company to defer substantially filing for bankruptcy. In re CRT Antitrust Litigation, MDL 1917.

Represented large retailers with substantial claims against domestic tuna producers, all of which admitted to price-fixing canned tuna, but had significant financial limitations. Developed a legal theory to sue each domestic manufacturer’s foreign corporate parent (Thai Union, Dongwon, Lion Capital), which substantially increased the clients’ recoveries despite each domestic defendant’s threats of bankruptcy. In re Packaged Seafood Antitrust Litigation, MDL 2670.

Prevailed in a pro bono criminal matter before the U.S. Supreme Court and Eleventh Circuit persuading the courts to extend protection under the First Amendment to political speech and overturn the client’s criminal conviction. Martinez v. United States, 576 U.S. 1001 (June 8, 2015); United States v. Martinez, 800 F.3d 1293 (11th Cir. Sept. 3, 2015).
