Date: November 2025
Summary:
This article explores recent developments in Dutch insolvency law, including the four insolvency procedures—bankruptcy, suspension of payments, debt restructuring for natural persons, and the WHOA pre-insolvency procedure. It discusses trends in bankruptcies and restructurings, such as the increase in filings following the pandemic and the impact of higher interest rates and tax debts. Significant cases shaping practice are analysed, including Blokker, McDermott, IHC Merwede, GINAF Trucks Nederland, Gerry Weber, Vanilia, Casa, and Amslod. The article also examines metrics and expected developments in insolvencies through 2027.
A key focus is the WHOA procedure, introduced in 2021, which is increasingly used by companies with fundamentally sound operations to restructure debt and avoid bankruptcy. The article highlights lessons from its practical application in high-profile cases.

Noor Zetteler is very thoughtful about charting a path. It is one thing knowing the law, but another thing to be able to avoid the minefield.
She is always available, gives very prompt responses and is very thoughtful in her advice.
