Career
Kathleen D. Weron is a shareholder in the Salt Lake office with an extensive employment law practice. Kathleen collaborates with her clients through proactive advice and counseling to ensure maximum compliance with federal and state employment laws and regulations. She regularly advises employers on Fair Labor Standards Act (FLSA) classification issues, leaves of absence and reasonable accommodation, restrictive covenants, and unfair competition, and she has helped implement WARN-compliant reductions in force.
Kathleen has represented employers before the EEOC, OSHA, the U.S. Department of Labor, the U.S. Department of Justice, and the Utah Labor Commission. She has successfully litigated issues involving sexual harassment, all Title VII protected classes, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family Medical Leave Act, and the FLSA, as well as restrictive covenants, misappropriation of trade secrets, employee privacy issues, defamation, and tortious interference with economic relations. Kathleen has successfully argued appeals to the Fifth and Tenth Circuits and the Utah Supreme Court.
Kathleen offers an array of employment services to her clients to promote best practices and productive work environments, including conducting employment audits of company practices, policies, and procedures to ensure compliance and alignment with corporate goals and needs. She designs, modifies, and implements customized employee handbooks, workplace policies, and agreements regarding confidentiality, noncompetition, nonsolicitation, and inventions assignments. Kathleen also drafts, reviews, and negotiates employment contracts and severance agreements.
Kathleen is also a well-known speaker, author and trainer. She conducts training on employment-related topics and provides comprehensive corporate harassment prevention training and executive training to create a diverse, inclusive, and professional work environment and culture. She has also conducted workplace investigations, providing strategic advice and legal counseling to clients in a wide-range of industries.
Kathleen has been annually recognized in Chambers USA® as an employment litigator “tremendously well versed in the law” with “considerable expertise” and an understanding of “the dynamic of employment relationships.” She has been voted by her peers as one of Utah’s “Legal Elite” in Labor and Employment Law in Utah Business magazine since 2004.
Kathleen is active in her business community. She serves on the Board of Advisors to the Economic Development Corporation of Utah where she is an active member of the Diversity, Equity, and Inclusion and Business Development Subcommittees. As a Leary Scholar from the University of Utah, S.J. Quinney College of Law, Kathleen served as a member of the Utah Law Review. After graduation, she completed a federal clerkship with the Honorable Ewing Werlein in the United States District Court for the Southern District of Texas.
