Duff practices in all areas of environmental law, commercial litigation and regulatory law. He routinely acts on the purchase and sale of environmental attributes (including offsets and renewable energy certificates) in both regulated markets and voluntary markets within Canada and internationally. He also undertakes environmental due diligence and environmental liability assessments pertaining to brownfield redevelopment, contaminant releases, regulatory approvals, and environmental audits. He is intricately familiar with Canada’s transportation of dangerous goods regime and its associated liability framework and has advised various clients on their roles and responsibilities under that regime. Duff also provides strategic regulatory environmental compliance and environmental impact assessment advice to industrial clients, such as conventional oil and gas companies, mining companies, companies operating in the oil sands, and liquefied natural gas proponents. Duff has acted as lead counsel in several litigation cases involving contaminated sites, and has appeared before numerous levels of courts and assessment tribunals on various environmental and regulatory matters.
