Dominic Kay KC is recognised by the directories as a leading Silk in the fields of Health & Safety, Environmental law and Inquests & Inquiries. He took Silk in 2017 having spent many years working exclusively in the field of regulatory law. He is a former winner of the Health & Safety Silk of the Year category at the Bar Awards, having been shortlisted as Silk of the Year in each of 2018, 2020 and 2023.
He is one of the country’s leading KCs in defending environmental prosecutions. His environmental law work involves representing companies charged in relation to major pollution incidents, often but not exclusively of the watercourse. He is currently retained to advise and represent several of the UK’s water companies in relation to Environment Agency prosecutions and other investigations relating to the water industry.
His practice involves representing the UK’s largest companies in relation to complex incidents across multiple sectors including healthcare, construction, agriculture, utilities, food manufacture, education and transport. He specialises in cases involving significant quantities of technical evidence. He has undertaken a large number of corporate and individual manslaughter trials and is instructed in the area’s most high profile cases. In 2021 he was described as “by far the best of the young Silks in this area”. His practice includes representing interested persons and core participants in health and safety-related inquests and inquiries.
Dominic has considerable experience of dual agency prosecutions, and his experience extends to Judicial Review proceedings in relation to his work areas.
