Career
David Burman has more than 40 years of experience leading complex antitrust and unfair competition litigation before state and federal courts. He provides antitrust counseling across matters such as compliance programs, investigations, transactions, pricing and marketing practices, and trade organization participation. He also defends high-value IP and patent litigation, and consumer protection claims, including class-action suits alleging unfair or deceptive practices.
Dave has worked on many high-profile cases, including two arguments before the Supreme Court of the United States. He was part of the trial contesting the 2004 Washington state governor's election, Costco Wholesale Corporation's precedent-setting antitrust and constitutional challenges to state wine and liquor laws, and the Yellow Pages publishers' successful constitutional challenge to municipal restrictions on distribution. He served as national counsel for defendants in two of the nation’s largest multidistrict litigations.
Dave was selected as a representative to the Ninth Circuit Judicial Conference and as a member of the National Civil Rules Advisory Committee and the Ninth Circuit Rules Advisory Committee. He was also chosen as a fellow of the American College of Trial Lawyers and as a member of the American Law Institute, where he was an adviser in drafting the Principles of Aggregate Litigation.
Dave serves as one of the deans of the trial bar for the firm’s Seattle office and formerly served as chair of the Commercial Litigation practice.
