David Gold represents clients in commercial litigation involving complex financial transactions, financial restructuring, bankruptcy, and distressed real estate.
David advises debtors, creditors, master and special servicers, and trustees, with an emphasis on the hospitality industry. David has assisted secured lenders, major hotel brands, creditors, and debtors in all aspects of Chapter 11 restructurings, assignments for the benefit of creditors, out-of-court transactions, and general litigation. He also counsels on secured transactions under the Uniform Commercial Code, lien and judgment enforcement, and asset protection.
Experienced in business litigation in state and federal courts, David has tried cases across the United States ranging from contested plan confirmation hearings and avoidance actions to business torts and commercial contract disputes. David frequently represents parties in post-trial judgment enforcement, defense, and compliance. He advises financially troubled businesses regarding bankruptcy and non-bankruptcy alternatives, and directors and officers of such businesses on mitigating litigation risk. With David’s experience in commercial mortgage-backed securities (CMBS) loan workouts, he has prosecuted and defended foreclosure and receivership actions for commercial properties, including hotels, office buildings, shopping centers, and single-use properties.
