David (“Dave”) Fletcher has nearly 20 years of broad government contracts experience that combines sophisticated regulatory counseling and highly specialized litigation, focusing particularly on issues of importance to technology companies and those that invest in such companies.
Dave advises clients ranging from startups to large public corporations on the statutes and regulations that control business relationships between contractors and their government customers. He counsels companies on the meaning and operational effect of the Federal Acquisition Regulation (FAR), the Defense Federal Acquisition Regulation Supplement (DFARS), Small Business Administration (SBA) size standards, and other regulations incorporated in contracts, grants, cooperative agreements, CRADAs, and other transaction agreements (OTAs). Dave prepares and negotiates the terms of subcontracts, subawards, and teaming agreements, provides government contracts compliance training, and develops compliance programs.
Dave represents contractors in disputes over the award and performance of government contracts, including bid protests at the U.S. Government Accountability Office (GAO), the Court of Federal Claims, and agency-level protest forums, and contract claims at the Boards of Contract Appeals. He also represents clients in internal and government investigations of potential misconduct related to government contracts, including mandatory disclosures and suspension and debarment proceedings.
