Career

Carrie Mount is the co-leader of Miller Nash’s insurance recovery team. She represents commercial policyholders across a wide range of industries, providing counsel and advocacy across myriad coverage lines. She has recovered significant insurance benefits for clients through claim negotiations, mediations, appraisals, and litigation including dispositive motion practice and jury trial.

Carrie is particularly experienced in declaratory actions, extra-contractual liability analysis, including under Washington’s Insurance Fair Conduct Act (“IFCA”) and bad faith law, long-tail claims involving historical policy identification, and multi-carrier coverage towers. Carrie also advises clients on insurance issues in agreements, including vendor contracts and mergers and acquisitions. Her creative problem solving, combined with deep knowledge of insurance coverage law, makes her an indispensable advocate for policyholders.

A frequent speaker on insurance coverage topics at national legal conferences, Carrie enjoys the challenge of crafting compelling presentations and making new connections.

Insurance Recovery

- Recovered millions of dollars for a commercial developer in a builder’s risk dispute, securing a favorable appraisal award and subsequent settlement after the insurer contested the scope of covered losses.

- Obtained summary judgment establishing the applicable coverage trigger in a series of liability policies on behalf of a state service provider, unlocking previously denied coverage.

- Coordinated settlement authority from several liability insurers on the eve of mediation, securing a policy limits settlement for a client facing a jury trial that threatened an eight-figure verdict.

- Obtained a favorable settlement on behalf of several restaurants for losses arising from the COVID-19 pandemic.

- Reversed a liability insurer’s wrongful denial of defense coverage and secured ongoing defense for a client facing a class action lawsuit alleging approximately 300,000 putative members.

- Obtained coverage under both a fidelity bond and a cyber policy for a financial services company that suffered significant funds transfer fraud losses, securing recovery across multiple coverage lines.

- Secured summary judgment in a declaratory action that established an insurer’s duty to defend a non-profit organization; obtained a stay of the case and reimbursement of the client’s fees under the Olympic Steamship doctrine.

- Recovered defense costs wrongfully withheld by an insurer that improperly characterized as incurred for “affirmative claims.”
