Brian Gardner is among the most active tax litigators in the Southeast. Under the age of 40, he has already participated in nearly a dozen tax trials in the U.S. Tax Court (including as lead counsel), two U.S. Courts of Appeals briefings, and numerous pre-trial motion briefs.
Brian has extensive experience working with the IRS and DOJ in matters concerning, among other things, defense of conservation easements, passive activity losses, net operating losses, estate taxes, 831(b) captive insurance, promoter penalties, employment taxes, and international tax issues. He has been involved in tax litigation cases in U.S. District Courts, U.S. Court of Federal Claims, U.S. Court of Appeals for the Eleventh Circuit and the Federal Circuit.
