Barak Cohen represents two kinds of clients: companies and individuals facing government enforcement and investigations, particularly in highly regulated industries and in sensitive corruption matters, and, as founder and chair of Perkins Coie’s Cannabis Law group, he represents companies in litigation, regulatory compliance, and investigations that involve the cannabis industry.
In his white-collar practice, Barak has particular experience representing companies that do business with the government, such as government contractors, tech companies, medical labs, medical device companies, and pharmaceutical companies, in investigations that involve fraud, waste, and abuse, and the False Claims Act (FCA) and kickbacks, as well as investigations led by agency inspectors general. He has also represented multinational companies in sensitive international investigations involving bid-rigging and international corruptions laws, such as the Foreign Corrupt Bribery Act (FCPA) and the U.K. Bribery Act. Barak is also a recognized expert in the area of public corruption and alleged political crimes. He has represented clients, including multiple sitting members of Congress, in USDOJ, Special Counsel, and state investigations regarding, among other things, bribery, campaign offenses and election crimes, the Foreign Agents Registration Act (FARA), and ethics offenses. In his cannabis practice, Barak represents international brands, multistate operators, and startups in civil litigation, investigations, and regulatory compliance matters that intersect with other diverse industries, ranging from e-commerce and technology platforms that facilitate cannabis transactions, to product-handling dispensaries and brands.
