Ayoub Mtafya

Ayoub Mtafya, is a Business and Corporate Law practitioner for the past 26 years. He has been involved in setting up corporate entities in Tanzania and ensuring that they are in compliance regulatory requirements from different regulatory agencies including the Tax Revenue Authority. Ayoub Mtafya has been instrumental in providing advisory on business operations, corporate governance, financing (IPOs), Securities and listing of companies with Dar es Salaam Stock Exchange (DSE). He has been involved in Mergers and Acquisitions, conducting due diligence on various legal aspects of companies. Ayoub Mtafya has been involved in insolvency whereby he has been a Liquidator of several companies, provided advisory on insolvency and petitioned for winding up of companies. He has acted as an administrative receiver of a company and as a Receiver and Manager for banks on recovery of debts. Mr. Mtafya has also been supporting the litigation team in commercial litigation and overall dispute resolution including arbitration.

In taxes, Ayoub Mtafya has provided tax advisory on several tax issues including tax settlement negotiations with the Tanzania Revenue Authority, handled tax objections against Tanzania Revenue Authority (TRA) decisions, represented clients at the Tanzania Revenue Authority, Tax Revenue Appeals Board, Tax Revenue Appeal Tribunal, and the Tanzania Court of Appeal

• Represented MIC Tanzania Limited ( now Honora Tanzania Plc) in ab arbitration dispute between Konnect Telecom Company Limited vs MIC Tanzania Limited before an Arbitral Tribunal in a claim of USD 3.4 million

• Represented Tanzania Breweries PLC and TBL Employees Trust Fund in an Arbitration case lodged by ex-employees in a claim of USD 24.4 million

• Was part of Deloitte team, NexLaw was engaged by the World Bank in the review of various laws, regulations, and bylaws in the course of assessing PPP projects for Mbeya, Arusha, Mwanza and Moshi Municipalities

• In 2020 NexLaw Advocates was engaged by the Alliance for a Green Revolution in Africa (AGRA) to conduct a review and analysis of policy and legislative framework for food security and export trade in Tanzania

• In the year 2022, Ayoub Mtafya was part of the team of Economic and Social Research Foundation (ESRF) in the baseline assessment of laws affecting Start Ups a report which was submitted to the Tanzania Startup Association (TSA)
