Andrew Kibaya continues to advise the Bank of Uganda on significant banking and finance matters including claims and demands made against regulated entities and persons and the Central Bank in Uganda and in England.
Andrew Kibaya represenst several domestic banks including I & M Bank, Exim Bank, NCBA Bank, Bank of Africa and Diamond Trust Bank as well as regional and international lenders. Key among these are; International Finance Corporation, International Fund for Agricultural Development, Trade and Development Bank and European Investment Bank. Notably the firm also acts for the Central Bank/ Bank of Uganda.
Andrew Kibaya advised the Central Bank of Uganda on other regulated entities and persons on select aspects including regulatory positions on the closure, receivership and liquidation of Crane Bank Uganda Limited including claims arising in connection with the said actions.
Andrew Kibaya provided legal support to MTN Mobile Money Uganda Limited, a fintech subsidiary of MTN Uganda in its application to Bank of Uganda and acquisition of the relevant licenses under the National Payment Systems laws.
Andrew Kibaya is currently advising Mercantile Credit Bank in respect of the implementation of directives from the Central Bank as regulator in relation to various aspects of its corporate structure. The details of this transaction remain confidential.
Andrew Kibaya provided advice to various cross boarder lenders providing finance to local SMEs and to local banks for on lending to small business entities. The transactions included financing by Cauris Series LLC – Africa Capital Series 2022 in respect of proposed senior secured term loan facilities to Asaak Financial Services Limited a Ugandan based entity and Asaak Financial Services Limited; and Lendable Asset Management LLC together with other lenders in respect of lending to and the restructuring of security issued in their favour by Watu Credit Uganda Ltd.
Andrew Kibaya has from time to time advised I&M Bank Uganda on various bank regulatory matters arising from the takeover and restructure of the Bank from Orient Bank to I&M Bank.
