Four of S&A’s senior attorneys collaborate with Afghanistan Center for Commercial Dispute Resolution and ICC-Afghanistan as arbitration practitioners and members of Arbitration and Alternative Dispute Resolution Commission. Notable Clients & Transactions:
■ Represented and advised a wide range of USG and NATO agencies, contractors and private security companies in Afghanistan on various legal matters, which included representing and advising a leading US-DoD contractor in a USD 100,000,000.00+ tax dispute that involved interactions with the Afghan Ministry of Finance, the Afghan Attorney General’s Office, and the Embassy of the United States in Kabul
■ Assisted and advised numerous foreign and international clients on tax exemption cases from the stage of filing necessary forms to obtaining tax clearance certificates. This included successfully resolving numerous complex tax matters of international corporations, unfreezing their bank accounts and assisting to lift other sanctions in Afghanistan that were imposed as a result of their tax issues
■ Successfully represented a major USG contractor before the courts in Afghanistan in relation to a human resource related dispute brought up as a class action by 350+ former employees
■ Assisted in transfer of ownership of a real property from a private individual to the name of a major international organisation in Afghanistan, which was the first of its kind in the recent past of the country. This was followed by two other successful transfers by this law firm of real property ownership from private individuals to foreign diplomatic missions in Afghanistan
■ Completed two major solar-project transactions from initial stages of due diligence to the final stage of closing and contract execution
■ Successfully represented Afghanistan’s largest private bank in several transactions and litigations before relevant courts and entities in Afghanistan
■ Advised on complex legal issues and transactions and successfully represented the largest local private construction project in Kabul
■ Led the drafting stage of Afghanistan’s first accountancy legislation, which passed into law as the 'Law of Professional Accountants,' in cooperation with the Ministry of Finance of the Islamic Republic of Afghanistan
■ Conducted intensive capacity building trainings for staff of different departments of the Ministry of Counter Narcotics of the Islamic Republic of Afghanistan
■ Advised 200+ clients including major local, foreign and international corporations as well as 10+ foreign diplomatic missions in Afghanistan on various legal matters including but not limited to civil, employment, commercial, contracts, business registration, investment, taxation and real property issues
■ Registered and obtained business licenses for 100+ foreign companies and businesses operating in Afghanistan
■ Has continuously advised and cooperated with 20+ major international law firms on international transactions and Afghanistan laws
■ Represented local and foreign businesses in International Arbitration proceedings
■ Drafted and prepared for local and foreign clients various agreements including shareholder agreement, joint venture agreement, partnership agreement, merger agreement, real estate purchase agreement, lease agreement, and employment agreement in light of applicable laws
■ Assisted in resettlement of tens of indigent abandoned Afghan women in the U.K. on a pro bono basis
