Litigation: Securities:
Pomerantz’s securities litigation practice, led by Managing Partner Jeremy A. Lieberman, represents institutional and individual plaintiffs in class and private actions. Pomerantz’s clients include some of the most influential pension funds, asset managers and institutional investors from around the globe. Its proprietary, state-of-the art PomTrack® portfolio monitoring system currently safeguards over $5.6 trillion in assets under management and continues to grow.

For over 80 years, Pomerantz attorneys have developed innovative legal theories to address the evolving legal, social and commercial landscape, as evidenced by its current litigation catalogue of cases involving the #MeToo movement, internet data breaches and virtual gaming.

The firm’s ground-breaking work to advance the interests of its global clients, irrespective of where they trade securities, has led to game-changing legal decisions. Pomerantz recently achieved a historic victory for investors in the securities fraud class action against the Perrigo Company plc by obtaining class certification for investors that purchased securities on a non-US exchange. This is the first time that a US district court has certified a class of non-US purchasers since the U.S. Supreme Court’s 2010 decision in Morrison v. Nat’l Australia Bank which barred purchasers of securities on foreign exchanges from pursuing federal securities law claims in US courts. Similarly, Pomerantz is making history in its representation of institutional investors in BP plc (‘BP’) to recover losses from purchases of BP shares on the London Stock Exchange stemming from the devastating 2010 Deepwater Horizon oil spill. Thanks to rulings secured during this litigation, Pomerantz now leads the only litigation, post-Morrison, where US and foreign investors are pursuing foreign claims in a US court under UK common law.

Recent firm wins include:
■ $110 million settlement in a high-profile securities class action against Fiat Chrysler based on claims that the company concealed that it improperly outfitted its diesel vehicles with ‘defeat device’ software designed to cheat emissions regulations in the US and Europe
■ $80 million settlement in a ground-breaking securities class action against Yahoo!, alleging that the internet giant intentionally misled investors about its cybersecurity practices in the wake of massive data breaches that compromised the personal information of all 3 billion Yahoo customers. This is the first significant settlement to date of a securities fraud class action filed in response to a data breach

Pomerantz vigorously advocates for corporate governance reform. The firm has won many landmark decisions that have enhanced shareholders’ rights and improved corporate business practices.

The firm’s partners, a skilled and diverse team of experienced litigators, are regularly invited to speak to institutional investors worldwide on matters of importance to their funds, whether it be the return on investments of Environmental, Social and Governance investing or how to use securities litigation to hold wrongdoers accountable and recover assets lost to fraud.

Pomerantz’s expertise is regularly praised by the courts. Its accomplishments have been featured in global media outlets, including Forbes, The New York Times, the Wall Street Journal and the Financial Times. The firm was honoured as Plaintiff Firm of the Year by Benchmark Litigation; its attorneys have been awarded for excellence by, among others, the National Law Journal, Lawdragon, Super Lawyers, and Law360.
