Lately, NPG has advised the Ministry of Economy and Finance of Peru (MEF) in special public procurement regulations to apply international standard forms of contracts and best practices in public mega projects.

Main Areas of Practice:

Engineering:
NPG advises clients and provides them with important information regarding the project delivery system in order to choose the method that best suits their needs. In addition, it advises on the bidding stage. NPG provides legal advice throughout the whole tender and bidding process in public and private projects. It has extensive experience in drafting and negotiating different types of construction contracts according to the project delivery system chosen by the client (Design, Construction (traditional method), Design, Bid & Build (DBB), Design & Build (DB), Project Management at Risk – Agency, Integrated Project Systems, etc). The firm is consultants on FIDIC, NEC, ENAA and FAC-1 standard forms of contract. It has experience in projects that use Building Information Modelling, from conception up to the conclusion of the project.

Construction:
During the construction phase of the project, NPG gives on-site advice on managing the control book, reviewing communications between contractor, owner and surveyor, and in general proposing actions to fulfil contractual procedures and reduce the possibilities of a dispute. Its attorneys regularly visit the work site and, in some cases, are permanently assigned to it during the construction phase. They have wide experience in legal management of construction and consulting contracts. NPG advises on all communications between the parties in order to keep appropriate records of the information and possible legal issues that may arise during the project. Its attorneys help to design claims, if necessary, for disruptions, changes, extensions of time, additional payments and damages, among others.

Alternative Dispute Resolution & Arbitration:
Once a dispute has arisen, the team undertakes to design the best strategy to resolve it in accordance with its client’s interests, seeking the fastest procedure in order to save time and money and facilitate business relationships between the parties involved. If a controversy cannot be resolved through a process of negotiation or conciliation, NPG recommends that its clients use ADR methods, such us dispute boards or arbitration. The majority of our members are qualified to be part of a Dispute adjudication and avoidance board.

Public Private Partnerships:
The firm has extensive experience in public private partnerships in the infrastructure field. Lawyers have dealt with claims related to important PPP projects.
