• Subsurface Trespass Litigation:Represented upstream oil and gas producer in a jury trial in McMullen County, Texas. Brought claims against affiliates of Energy Transfer based on damages caused by the companies’ underground storage of acid gas. After a two-week trial, the jury awarded the client all of the damages requested (more than $17,000,000).
• Royalty Litigation: Represented Fortune 500 oil and gas company in lawsuit brought by royalty owners based on alleged underpayment. Secured summary judgment against owners in Southern District of Texas and the Fifth Circuit Court of Appeals later affirmed the decision.
• Energy Arbitration:Represented Fortune 500 oil and gas operator in a contractual dispute with major oilfield services company. Sought millions in damages and defended against eight-figure counterclaims. Following a six-day final hearing, obtained unanimous order from panel in favor of operator and later secured settlement for more than the original damages sought.
• Energy Contract Litigation: Represented oil and gas operator in a breach-of-contract and fraud lawsuit filed against it by a leading seismic data provider. Data provider sought seven-figure damages based on an alleged violation of the parties' agreement related to operator's drilling of Eagle Ford wells. Secured complete win for client by summary judgment order dismissing all claims.
• Lease Ownership Litigation:Represented energy company quiet title suit in New Mexico related to the ownership of valuable working interest rights in the Delaware Basin. The Court awarded client ownership of the interests at issue, which were worth millions of dollars.
