Gamboa, Fuenzalida, Sanfeliú & Ugarte (GFSU Abogados) was founded by Mr. Fuenzalida, ex-Carey senior associate of arbitration and civil team, Mr. Gamboa, ex-PricewaterhouseCoopers senior manager, head of the tax litigation team, and Mr. Ugarte, ex-tax administration and PricewaterhouseCoopers senior associate of the tax litigation team. All of them have considerable experience in their respective fields. Also, on 2015, the firm added a new partner, Mr. Sanfeliú, former public prosecutor and ex-director of the criminal department at Carey.

The firm, with 7 years from its foundation, already counts with 22 members, and is well-known at the local market as a litigation boutique. The legal specialties for which the firm is best known are: litigation and arbitration in civil and commercial matters; disputes against the Chilean Tax Administration, and; criminal cases as plaintiff or defendant before criminal courts on a wide range of complex cases, especially white-collar crimes.

Main Areas of Practice:

Tax Matters:
Mr. Gamboa (tax litigation) and Mr. Ugarte (tax advisor and counsel) lead the tax team in the firm. This team specialises in representing their client’s interests in disputes against the Chilean Tax Administration ('Servicio de Impuestos Internos'), against municipalities in trade patent cases, and leading the defence in complex jurisdictional processes pertaining liquidations, fees and charges issued by the Chilean Tax Administration, litigating before Tax Courts and Superior Courts of Justice. The tax team also provides legal counselling to local and foreign clients in financial and tax matters, delivering concrete and targeted solutions. This team also provides permanent counselling, designing commercial and tax-related strategies according to the necessities of the clients, among which there are prestigious domestic and foreign companies.

Arbitration, Civil & Commercial Litigation:
The civil and commercial litigation team is led by Mr. Fuenzalida. The team practice focuses on both national and international litigation at civil, commercial, public and regulatory law, electric, construction and engineering matters, before First Instance Courts, Superior Courts of Justice, and arbitrators. The team also has vast experience in complex negotiation processes, preventing future disputes. The arbitration, civil and commercial litigation team advices and represents companies in the electric, cement, construction, mining and banking industries, among others, as well as public entities in dispute resolutions and negotiations.

Criminal Matters:
Marcelo Sanfeliú leads GFSU’s criminal litigation group, which specialises in a wide range of complex cases, such as white-collar crimes, tax-related crimes, cyber-crimes, intellectual property violations, anti-corruption and money laundering cases; protection of sensitive company information and crimes against property in general, among others. The criminal litigation group also provides legal advice in crisis management, design and implementation of compliance programs, and preventive advice to its clients, representing them before all the public prosecutors’ offices and criminal courts through the country, with extensive experience in oral litigation, acting either as plaintiff or defence attorney.
