In December 2018, two of the most well-respected and highly ranked lawyers in Mexico, Fernando del Castillo and Alfonso Castro, launched a new law firm, Del Castillo y Castro Abogados, a niche law firm of seasoned professionals located in Mexico City and Monterrey. Main Areas Of Practice:
Del Castillo y Castro has handled debt restructurings often controlled by foreign investors. The firm has advised clients on the challenges demanded by private restructuring operations in which numerous creditors participate, or take place in different jurisdictions. The team is the first in Mexico to achieve a true consensual restructuring of a company through the new construct of commercial insolvency. For years, its lawyers have actively represented various manufacturing, commercial and service companies, in their capacity as debtors, in a wide range of financial operations, including: credits (guaranteed or unsecured); syndicated credits, either representing the administrative agent and guarantees in syndicated loans to one of the participants or to the Mexican debtor; financing of assets; and exchange of debt.
Del Castillo y Castro represents debtors and creditors in all the activities that are entailed in a complex restructuring. In addition to negotiations, the team has handled all the transactional aspects of a restructuring, including securities issues, as well as judicial aspects such as concurso and hostile litigation. No other team of lawyers has handled as many cases in concurso, as well as advising on corporate aspects of the restructuring.
Capital Markets, Banking & Finance:
The Del Castillo y Castro Abogados team has extensive experience as a legal advisor in the financial markets. For many years, its lawyers have participated in debt and equity instruments placement operations, as well as in public offers of purchase in different jurisdictions, acting jointly with foreign firms of great reputation in these matters.
The firm also represents issuers, underwriters, rating agencies, agents, and fiduciaries in a number of offers and other transactions involving securities and other financial instruments in Mexico, the United States, and Europe. Del Castillo y Castro participates in various operations involving the National Banking and Securities Commission, the Mexican Stock Exchange, SD Indeval, SA de CV, Institution for the Deposit of Securities, as well as the Mexican Derivatives Market (MexDer). The firm advises suppliers and consumers of all types of products and derivative instruments, including interest rates, currencies, capital, credit derivatives, repurchase agreements, and securities financing.

The firm represents clients on matters before the International Chamber of Commerce (ICC), the National Chamber of Commerce of Mexico City (CANACO), the Arbitration Center of Mexico (ACM), and other institutions that administer arbitration proceedings, including those of a public nature such as the National Commission for the Protection and Defense of Users of Financial Services (CONDUSEF). Civil & Commercial Litigation:
The firm’s litigation practice focuses on judicial disputes involving both national and international corporations across a broad spectrum of matters involving real estate, corporate, contractual, indebtedness (mortgage lawsuits, commercial executives, etc.), insolvency, and insurance and bonds, among others. The team also provides preventive advisory services in litigation matters and advises clients after disputes arise, either with individuals or with authorities. The firm’s litigators have extensive experience in the settlement of disputes, both in the extrajudicial area, and before the jurisdictional authorities, whether state or federal, such as Unitary Courts and Circuit Collegiate and including the Supreme Court of Justice of Mexico.
